TPD claims in the Northern Territory

Contact us

KSC Law helps people investigate TPD claims in the Northern Territory where illness or injury has affected their ability to work. The first step is to identify the TPD insurance that applied and the disability definition contained in that cover.

TPD insurance may be held through superannuation or outside super under a separate policy. Different policies can use different definitions of total and permanent disability, including “own occupation”, “any occupation” and activities of daily living definitions.

Could you have a TPD claim?

Total and Permanent Disability cover is held inside most super funds. Answer a few quick questions to see if you may be able to claim. This is a guide only, not a determination.

Have you stopped working because of an injury or illness?
Question 1 of 6

TPD claims generally require that you have stopped work and cannot return.

This is a general guide only, not an assessment of your policy or eligibility. TPD outcomes depend on your individual super fund or insurance policy terms. This does not constitute legal, financial or medical advice. Book a free consultation for a personalised assessment.

Building a clear medical history

Bring together the medical records you already have, particularly if you have seen different practitioners or received treatment in different locations.

The evidence should address the requirements of your particular TPD insurance policy rather than simply establish that you have been diagnosed with an illness or injury. The definition of total and permanent disability differs between insurers.

If there are gaps in treatment or records, explain the circumstances accurately rather than assuming the insurer will understand why treatment was interrupted.

Work history and policy requirements

Include your work history, qualifications and changes to your employment where relevant.

Under an “any occupation” definition, the assessment generally considers whether you are unable ever to work again in a job suited to your education, training or experience. Being unable to return to your last job does not necessarily establish that requirement. Other disability definitions may apply under your policy.

Check current and previous superannuation funds and any separate insurance policies. Moneysmart recommends checking whether you already hold TPD cover through super and what happens to that cover when employment changes or a super account becomes inactive.

Other entitlements

Northern Territory workers compensation and TPD insurance are separate arrangements. NT WorkSafe states that the Territory’s workers compensation scheme operates under the Return to Work Act 1986 and Return to Work Regulations 1986 and provides potential entitlements for injury or disease occurring in the course of employment.

A TPD insurance claim is instead assessed against the definition and requirements of the applicable insurance policy. Your illness or injury does not necessarily need to be work-related for a TPD claim.

For TPD cover held through superannuation, also check the rules governing access to the benefit and its tax treatment.
